Terms of Trade.

These Terms of Trade apply to all goods and services supplied by Inspire Design Ltd T/A Inspire Kitchens. By accepting a quotation, paying a deposit, or engaging our services, you agree to be bound by these Terms.

These Terms of Trade (“Terms”) apply to all goods and services supplied by Inspire Design Ltd T/A Inspire Kitchens (“Inspire Kitchens”, “we”, “us”, or “our”) to the customer (“you”, “your”). By accepting a quotation, paying a deposit, or otherwise engaging our services, you agree to be bound by these Terms.

1. Parties & Scope

These Terms cover the design, manufacture, supply, and installation of custom kitchens, cabinetry, and related products.

2. Quotations & Acceptance

All quotations are valid for 30 days unless stated otherwise. Acceptance occurs when you sign the quote or pay a deposit. Quotations include only the items specified. Removal of existing joinery, plumbing, or electrical work is excluded unless expressly stated.

3. Payment Terms

For residential customers, payment terms are 50% deposit upon acceptance and 50% payable three (3) business days prior to installation. The deposit is non-refundable, as it secures materials, design time, and production scheduling. If the project is cancelled after acceptance, Inspire Kitchens will retain the deposit to cover incurred costs and committed resources. For commercial or builder accounts, terms are as agreed in writing. Inspire Kitchens reserves the right to withhold delivery or installation until payment is received in full. Ownership of all goods remains with Inspire Kitchens until full payment is made.

4. Variations & Additional Work

Any variations or additional work must be confirmed in writing before commencement. Variations may affect quoted pricing and timelines. Inspire Kitchens will advise of any additional costs or delays before proceeding.

5. Design & Approvals

You are responsible for reviewing and approving all plans, materials, colours, and specifications prior to production. Inspire Kitchens is not liable for errors in unapproved or unsigned plans.

6. Lead Times & Scheduling

Lead times vary depending on materials and supplier availability. We will provide estimated delivery and installation dates but cannot guarantee these due to factors beyond our control (including supplier delays, freight disruptions, or force majeure events). We will communicate any changes promptly.

7. Delivery, Installation & Site Conditions

You must ensure safe and clear access to the site. All services (electrical, plumbing, flooring, and walls) must be ready prior to installation. Risk passes to you upon delivery to site, but Inspire Kitchens remains responsible for workmanship until completion of installation.

8. Warranty & Consumer Rights

We provide a 10-year warranty on workmanship and installation, and pass on all supplier warranties for materials and hardware. This warranty does not cover normal wear and tear, misuse, or damage by others. Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 (“CGA”) for personal or domestic customers. For commercial clients, the CGA is excluded to the fullest extent permitted by law.

9. Liability & Limitations

To the extent permitted by law, Inspire Kitchens is not liable for any consequential loss, loss of profit, indirect loss, delay, or damage arising from the supply, installation, repair, replacement, removal, or use of goods and services. Our total liability is limited to the value of the relevant contract.

Inspire Kitchens does not provide any warranty, guarantee, or accept any liability in respect of appliances, fixtures, fittings, plumbing, electrical components, or other third-party products not supplied directly by Inspire Kitchens.

This includes any appliance or third-party item that is fitted to, installed within, connected to, supported by, or used alongside Inspire Kitchens cabinetry, benchtops, or other products.

Where an Inspire Kitchens product requires repair, replacement, removal, or reinstatement under warranty, Inspire Kitchens’ responsibility is limited to the affected Inspire Kitchens product and the work required on that product. Any appliance or third-party item affected by, attached to, connected to, supported by, or installed in connection with that product remains excluded.

Unless expressly included in the quotation, Inspire Kitchens is not responsible for any cost or work associated with the disconnection, removal, storage, refitting, reinstatement, reconnection, testing, commissioning, repair, replacement, or certification of appliances or third-party products. This includes any resulting loss, damage, delay, or additional trade costs.

Any appliance removal, reinstatement, reconnection, or related work must be arranged and completed by the client or their nominated suitably qualified tradesperson.

10. Defects & Remedial Work

You must notify Inspire Kitchens in writing of any defects or damage within ten (10) working days of installation completion. Inspire Kitchens will inspect and, if appropriate, repair or replace the affected item within a reasonable timeframe.

11. Cancellation & Termination

If you cancel your order after production has begun, Inspire Kitchens may retain any deposit paid and charge for work completed or materials purchased. We may suspend work or terminate the agreement if payment is not received in accordance with these Terms.

12. Ownership & Risk

Ownership of all goods remains with Inspire Kitchens until payment is received in full. Inspire Kitchens may recover unpaid goods at your cost if payment is not made. Risk in goods passes to you upon delivery to site.

13. Force Majeure

Inspire Kitchens will not be liable for delays or failures caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, supplier failure, or transport disruptions.

14. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good faith discussion. If unresolved, the matter shall proceed to mediation before any court action is taken.

15. Privacy & Data

We collect and store customer information in accordance with the Privacy Act 2020. Information is used solely for fulfilling your order and providing aftersales support. You may request access to your information at any time.

16. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.
